Firm Successfully Defends Against Breach of Lease Action

The firm represented a tenant involved in a dispute with the landlord over unpaid rent.  During the tenancy, many significant problems existed with the leased property. After many calls and other correspondence with the Landlord, the problems remained unresolved. Tenant provided notice, moved out of the property and the landlord subsequently filed suit for rent and attorneys fees. At trial, attorneys for the firm argued that the tenant was not in breach of the agreement as he had given the proper notice and moved out of the unit when the deficiencies were unsuccessfully resolved in accordance with the lease agreement. Court held in favor of the tenant finding no liability.
